发现另一半出轨后，如何进行证据搜集呢？
1、捉奸尽可能邀伴同行
有些当事人出于家丑不外扬或者其他原因，知道对方在与他人通奸时，自己一个人去逮。
这样的结果，一旦涉讼，当事人所看到一切，在法律上仅是相当于当事人陈述，只要对方否认，则不能认定。
当知道对方准备或者正在与他人通奸时，尽可能邀请二到三个愿意出庭作证的人一起前往捉奸，并尽可能用照相、录音、摄像等方式作好影像记录。
2、尽可能多地收集间接证据，形成完整证据链
在现实生活中，能够取得“捉奸在床”的直接证据少之又少，往往需要收集尽可能多的间接证据。
如：qq或微信聊天记录、记录、短信内容、电子或纸质书信、两人在公共场合较为亲密的照片、一起旅游的合影、租房合同、物业和水电费凭据、开房记录、票据、视听资料、证人证言、互赠礼物、村(居)委会、派出所的证明等等，这些间接证据单独一样一般无法成立，但如果综合起来形成证据锁链，则可认定事实成立。
3、对易消失、更改的证据及时保全、固定
有些证据可能是稍纵即逝的，比如通奸现场等无法再现的场景，可以通过请求公权介入做笔录的方式固定，比如电子版、手机短信类容易被删改的证据，一旦取得最好及时通过公证的方式保全，这样，即使对方以后删除或者更改，也不受影响。
4、监听监视须谨慎
一些当事人为了取得另一半方不忠的证据，通过不正当途径采购、安装监听和监视设备，而我国法律对这些设备的使用有严格的法律规定，稍有不慎则可能会违反相关法律。
最终不仅因为取证违法所取得的证据不被采信，还可能因为侵害第三方的民事权利而承担相应的民事责任，甚至可能让自己承担行政以及刑事责任。
5、适当借助公权
当事人擅自闯入他人住宅取证，一方面可能引发侵权责任，另一方面也可能会导致所取得的证据不被采信，或者证明力低下等。
有时候，适当借助公权介入不失为一种好办法。
跟踪另一半与第三者，看到他们在宾馆开房进了房间，怎么办？建议打110报警，说明自己看到另一半跟陌生人正在宾馆开房，怀疑是在卖，但因为自己一个弱女子，如果硬闯进去怕人身安全受威胁同时也担心引发其他法律责任，需要求助警察介入。
6、证明“以夫妻名义”同居的思路
根据法律规定，重婚罪的构成要求双方是以夫妻名义同居且周围的人也认为其为夫妻，而我国刑法规定的重婚罪又是自诉案件，即需要控诉一方当事人自己去完成举证，公权力一般不主动介入，举证的难度极大。
现实生活中，重婚取证一般会有：以夫妻名义申报户口、购买及租赁住房、举行婚礼等。
我国婚姻登记与户籍登记并未联网，往往会出现登记结婚了户口上仍为未婚的情形，这样就可能出现登记后的一方，又异地与他人登记结婚，如果同时调取到两份结婚证，这就是确凿的直接证据，但现实中这种情况并不多见。
除此之外，就需要调取同居双方其他方面的证据，比如：对外以“老公老婆”介绍身份，以夫妻名义旅游聚会；邻居和亲友证言；如果与第三者生育子女，双方以配偶身份签字或者小孩出生医学证明记载双方为父母亲等。
7、法庭调查中巧妙发问，确认相关事实
根据法律，如果一方当事人承认的事实，可以免除另一方的举证责任。
如果经过前述努力，仍无法取得足够证据，也不要悲观泄气。
有时利用法庭调查中互相发问环节，通过巧妙的问话设计，让对方在回答问题中承认相关事实或者将本不完整的证据链补充完整起来，也可能会取得意想不到的效果。
当然，这种效果的取得，需要发问者有丰富的经验和高超的技巧，而且还带有很大的偶然性。
